Business Litigation Committee

Who We Are

The Business Litigation Committee consists of attorneys whose practices focus on the litigation of disputes arising from commercial and business relationships. The membership of the committee engages in diverse areas of practice within business litigation law and includes attorneys from large and small firms as well as solo practitioners. The committee has organized seminars and other activities of interest to business litigators. Further, the committee was operative in the establishment of a separate certification area for business litigation attorneys.

Current Projects

  • Legislation Subcommittee, HB 313 UCC
  • Business Litigation Certification Review Course
    • Increase visibility of course for board certification candidates
    • Finish update course modules
  • Support of Computer Abuse Non-disclosure and Data Recovery Act (“CADRA”) proposed legislation
  • Working with other Committees on a substantial update and rewrite of the Proceedings Supplementary statute
  • Review of proposed changes to Rule 4-4.2 of the Rules of Professional Conduct regarding lawyer contact with non-lawyer government workers.
  • Review and revising proposed legislation on identity theft of officers or directors of corporations
  • Working with other Committees on a substantial update and rewrite of Florida Statute Chapter 607, the statute governing corporations.
  • Working on a draft of a Florida version of the Uniform Interstate Depositions Act.

Recent Projects

Drafting the Florida Revised Arbitration Act. Committee members testified before the Legislature and worked with numerous government officials and interest groups in moving the proposed measure through bill drafting and passage. It was enacted into law by Governor Scott.

Working, along with other Committees, on drafting a revised version of the Florida Limited Liability Company Act, which was enacted into law last year.
